The terms on which M-Penny (a trading style of Natcrest Holdings Company Ltd) prepares and submits KRA returns for a merchant.
VERSION tf-v1
M-Penny — directly or through independent Certified Public Accountants (CPAs) in its network — prepares and submits your tax returns to the Kenya Revenue Authority (KRA) based solely on the books, records, figures and documents you submit through the M-Penny platform.
M-Penny's role is limited to preparing and submitting the return from the submitted data. You remain the taxpayer of record and remain responsible for the return and for your tax affairs. This is a preparation-and-submission service, not personalised tax or legal advice.
After a return is filed, you have thirty (30) days to raise any concern about that filing in writing to M-Penny (support@mpenny.ke). If no concern is raised within 30 days, the filing is deemed accepted and correct as filed, and M-Penny's obligations in respect of that filing are deemed fully discharged and settled.
You indemnify and hold harmless M-Penny, Natcrest Holdings Company Ltd and its network CPAs against any claim, penalty, cost or liability arising from the data you submit or from your acts or omissions.
Where a filing is prepared or reviewed by an independent CPA in M-Penny's network, that professional acts on the submitted data. M-Penny facilitates and coordinates the engagement; the professional relationship and any professional opinion are between you and the professional.
Your records are handled confidentially and processed under the Data Protection Act, 2019 for the purpose of preparing and submitting your returns.
These terms are a draft pending review by a Kenyan advocate before execution. By ticking acceptance in the M-Penny app you confirm you have read and agree to them for the relevant filing. © Natcrest Holdings Company Ltd.
